The rules of the courtyard.

1. Who you are dealing with

The website fundaro.capital (the "Site") is operated by Fundaro Ltd. ("Fundaro", "we", "us"), a P2P real estate lending platform operating from Málaga, Spain. You can contact us at hi@fundaro.capital.

2. What the Site is - and is not

The Site presents Fundaro, our approach to real estate lending and editorial content in our Journal. It is informational only. Nothing on the Site constitutes:

  • an offer, solicitation or recommendation to lend, invest or enter into any transaction;
  • investment, legal, tax or other professional advice;
  • a guarantee of any return, yield or outcome.

Actual lending through Fundaro is available only to persons who complete onboarding - including the checks in our AML & KYC Policy - and is governed by separate loan documentation that prevails over these terms.

3. Eligibility

You may use the Site and join the waitlist only if you are at least 18 years old and have full legal capacity. Access from jurisdictions where the content would be unlawful is not permitted; you are responsible for compliance with your local rules.

4. The waitlist

  • Joining the waitlist requires only an email address and is free.
  • It does not create any right to participate in a cohort, access loan listings or receive any allocation - cohort access is at our discretion and subject to onboarding.
  • By joining you agree to receive occasional updates from Fundaro. You can unsubscribe at any time with the link in every email; how we handle your data is described in our Privacy Policy.

5. Risk warning

Lending involves risk, including the loss of the capital you lend. Returns shown anywhere on the Site are targets, not guarantees. Past performance does not predict future results. Loans are not bank deposits and are not covered by any deposit guarantee scheme. Security arrangements reduce risk; they do not remove it. Before participating in any loan, read the applicable loan documentation and risk disclosures carefully and, if in doubt, take independent advice.

6. Intellectual property

The Site and everything on it - the Fundaro name and logo, text, graphics, photography, page design and code - belong to Fundaro or its licensors. You may view, download and print pages for personal, non-commercial use. Any other reproduction, distribution or use requires our prior written consent.

7. Acceptable use

You agree not to misuse the Site - in particular, not to attempt unauthorised access, probe or scan its infrastructure, introduce malicious code, scrape content at scale, submit false information, or use the Site in any way that breaks applicable law.

8. Third-party content and links

The Site links to third-party websites and cites third-party publications, and our Journal reports on market data from external sources. We do not control and are not responsible for third-party content, and a link is not an endorsement.

9. Disclaimers and liability

The Site is provided "as is" and "as available". We work hard to keep it accurate and online, but we do not warrant that it is error-free, complete, up to date or uninterrupted. To the maximum extent permitted by law, Fundaro accepts no liability for loss or damage arising from use of, or reliance on, the Site or its content - including indirect or consequential loss and loss of profit.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, or affects the statutory rights you hold as a consumer.

10. Changes to the Site and these terms

We may change, suspend or discontinue any part of the Site at any time. We may also update these terms; the version published on this page, with the date shown at the top, is the one in force. Material changes will be highlighted on this page.

11. General provisions

If any provision of these terms is found invalid, the remaining provisions stay in force. A failure to enforce a provision is not a waiver of it. These terms are drawn up in English.

12. Governing law and jurisdiction

These terms are governed by the laws of Spain. Disputes arising from the use of the Site are subject to the courts of Málaga, Spain - except where you are a consumer and mandatory consumer-protection rules give you the right to bring or defend proceedings in your own country of residence.
